Our firm has successfully resolved many DUI cases before they have gone to trial. Whenever possible, we try to get DUI charges dropped or reduced to a nonalcohol driving offense. There are cases, however, when going to trial is the right decision.

The DUI Trial Process in Pennsylvania

When you retain us to represent you, our defense effort will begin long before the trial begins. We will thoroughly review the events leading to the vehicle stop and your arrest, blood alcohol test results and other aspects of your case. We may retain experts in blood alcohol testing and other disciplines who can support your case. Whenever possible, we will make pretrial motions (also called motions in limine) in the preliminary hearing seeking to suppress evidence or get the charge dismissed.

The next stage in the process is jury selection. It is critical that the jury members be fair and open-minded. Our lawyers will take this opportunity to exclude a limited number of jurors who they believe could be prejudiced against you.

After the prosecutor and defense make their opening statements, the actual trial will begin. The prosecutor will first present the Commonwealth’s case, by introducing evidence and examining witnesses. Your defense attorney will be able to cross-examine the state’s witnesses, a process that can reveal inconsistencies in the testimony of witnesses such as police officers and experts.

At this point, we can present our own evidence and call our own witnesses. In a felony DUI case involving an accident, for example, these could include an accident reconstruction professional, field sobriety test expert, blood alcohol test expert and other witnesses. Following summary statements by the prosecutor and defense, the case will then go to the jury.
