Prior to a DUI Arrest

Police cannot arrest you for DUI just because they think that you are intoxicated. For an arrest and subsequent prosecution to hold up in court, they must have witnessed actual behavior that gave them reason to believe that you were intoxicated at the time you were driving. To obtain this evidence, they conducted an investigation and made observations following the vehicle stop.

An officer is trained to look for certain things during this investigation. Before you were arrested, the officer probably looked into your eyes for signs of intoxication. The officer may have thought that he or she detected the smell of alcohol on your breath. The officer probably engaged you in conversation and listened for slurred speech. At some point, the officer may have asked you to perform field sobriety tests.
