The Charges Against You can Bring Stiffer Penalties

In Pennsylvania, the consequences of a DUI charge are already severe. Enhancements are penalties added to the base charges, depending on the circumstances of the arrest and associated events. Enhancements to the original DUI penalties may include:

  • High blood alcohol content (BAC) — Pennsylvania has three levels of BAC penalties. The higher your BAC, the more stringent the penalties.
  • Multiple DUI charges — If you have a repeat DUI charge within 10 years of your first, your penalties may be increased.
  • Felony DUI with injury — If you were driving while intoxicated and caused an accident in which someone was hurt, it is a felony charge and the punishment will be enhanced.
  • Aggravated assault while under the influence — More severe than a felony DUI, this charge is a second-degree felony and usually involves life-threatening injuries to the victim.
  • Homicide while under the influence — This charge involves the unintentional death of the victim in an accident caused by drunk driving. There is a minimum three-year prison sentence for the death of each victim in the accident.
